These Terms of Service ("Terms") govern your access to and use of the Search OS platform ("Service"), operated at usesearchos.com and app.usesearchos.com. By accessing or using the Service, you agree to be bound by these Terms.
If you are using the Service on behalf of an organization (such as an agency), you represent that you have the authority to bind that organization to these Terms.
Search OS is a software-as-a-service (SaaS) platform designed for SEO and digital marketing agencies. The Service provides tools for managing clients, executing standard operating procedures (SOPs), generating AI-powered research and action plans, tracking tasks and projects, and connecting to third-party data sources such as Google Search Console, Google Analytics, and Google Business Profile.
You must be at least 18 years old to use the Service. By creating an account, you represent that you meet this requirement.
You are responsible for:
We are not liable for any loss resulting from unauthorized use of your account.
If you create or manage an organization account, you are responsible for the actions of all users you invite to that organization. You may assign roles (admin, manager, member) with different levels of access to features and client data.
The Service is offered through subscription plans, currently including Launch, Grow, and Advisory tiers. Plan features, pricing, and limits are described on our pricing page and may be updated from time to time.
We may offer free trial periods at our discretion. At the end of a trial, your account will convert to a paid subscription unless you cancel before the trial ends.
We reserve the right to change subscription prices. We will provide at least 30 days' notice of price increases. Continued use of the Service after the price change takes effect constitutes acceptance of the new pricing.
You agree not to:
We reserve the right to suspend or terminate accounts that violate these rules.
You retain ownership of all data and content you submit to the Service ("Your Data"), including client information, SEO research, project data, and uploaded files.
By submitting Your Data to the Service, you grant us a limited, non-exclusive license to use, store, and process Your Data solely to provide and improve the Service. This license terminates when you delete Your Data or close your account.
The Service uses artificial intelligence to generate research reports, action plans, recommendations, and other content. AI-generated content is provided as-is for informational purposes. You are solely responsible for reviewing, editing, and verifying any AI-generated content before presenting it to your clients or acting on it.
You are responsible for ensuring that you have the right to submit any data to the Service, including client data. If you manage client data on behalf of third parties, you are responsible for obtaining any necessary consents and complying with applicable data protection laws.
The Service allows you to connect Google Search Console, Google Analytics 4, and Google Business Profile through Google OAuth 2.0. By connecting these services:
The Service may integrate with additional third-party services. Your use of those services is governed by their respective terms and privacy policies. We are not responsible for the availability, accuracy, or practices of third-party services.
The Service, including its software, design, logos, documentation, SOPs, training content, and Academy materials, is owned by Search OS and protected by intellectual property laws. These Terms do not grant you any rights to our intellectual property except the limited right to use the Service as described here.
If you provide feedback, suggestions, or ideas about the Service, you grant us a perpetual, irrevocable, royalty-free license to use that feedback for any purpose without obligation to you.
Each party agrees to keep confidential any non-public information received from the other party in connection with the Service. This includes but is not limited to client data, business strategies, and technical information. This obligation does not apply to information that is publicly available, independently developed, or required to be disclosed by law.
The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory. We disclaim all warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not guarantee any specific SEO results, search engine rankings, or business outcomes from using the Service. SEO performance depends on many factors outside our control.
AI-generated content may contain inaccuracies, outdated information, or errors. You acknowledge that AI outputs should be reviewed by qualified professionals before use.
We do not warrant the accuracy, completeness, or timeliness of data retrieved from third-party services such as Google Search Console, Google Analytics, or Google Business Profile.
To the maximum extent permitted by law, in no event shall Search OS, its officers, directors, employees, or agents be liable for:
Our total aggregate liability for all claims arising from or related to these Terms or the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.
You agree to indemnify and hold harmless Search OS, its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from:
You may terminate your account at any time by canceling your subscription and contacting support@usesearchos.com.
We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Reasons for termination may include violation of these Terms, non-payment, or if we discontinue the Service.
Upon termination:
These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles.
Any disputes arising from these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, conducted in English in the State of Delaware.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Search OS regarding the Service and supersede all prior agreements.
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.
You may not assign your rights under these Terms without our prior written consent. We may assign our rights without restriction.
We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms and updating the "Last Updated" date. Your continued use of the Service after changes are posted constitutes acceptance.
